These Terms of Use (the “Terms”) govern access to and use of the Surveynaire website and platform (the “Service”). The Service is operated for academic research purposes. By creating an account, accessing the Service, or submitting a response to a questionnaire hosted on the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to create an administrator account or submit a response. You agree to provide accurate information when registering and to keep your login link, email account and any authentication tokens confidential. You are responsible for all activity that occurs under your account.
Surveynaire is provided on an “as is” and “as available” basis as a research and educational tool. It is not a commercial product and is not intended for the storage or processing of sensitive personal information beyond what is strictly necessary for the questionnaires it hosts. The operator may modify, suspend or discontinue any part of the Service at any time without notice.

The operator may suspend or terminate access, remove content, and cooperate with law enforcement in respect of any conduct that, in its reasonable opinion, breaches this policy.
Any questionnaire content you create or response you submit remains your own. By submitting content to the Service, you grant the operator a non-exclusive, royalty-free licence to host, store, display and process it solely for the purpose of operating the Service and conducting the associated academic research. Aggregated and anonymised results may be published in academic outputs.
The Service is operated in accordance with the Protection of Personal Information Act, 2013 (Act No. 4 of 2013) (“POPIA”). Personal information collected from administrators is limited to your name, email address and authentication metadata, and is used solely to operate the Service. Survey responses are pseudonymised. You may request access to, correction of, or deletion of your personal information at any time by contacting webmaster@surveynaire.com.
To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory or otherwise. The operator disclaims all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, security, or that the Service will be uninterrupted or error-free. You use the Service at your own risk.
To the maximum extent permitted by applicable law, in no event shall the operator or any of its directors, employees, agents or affiliates be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Service, whether based on warranty, contract, tort (including negligence), statute or any other legal theory, and whether or not the operator has been advised of the possibility of such damage.
You agree to indemnify, defend and hold harmless the operator and its representatives from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of, or conduct on, the Service; (b) your breach of these Terms or any applicable law; or (c) any content you submit to the Service.
The Service relies on third-party providers (including, but not limited to, hosting, email delivery and Google reCAPTCHA). Your use of such third-party services is subject to those providers’ own terms and privacy policies, and the operator is not responsible for them.
The operator may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including liability, indemnity, and content licence) shall survive.
The operator may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of South Africa. You submit to the exclusive jurisdiction of the South African courts in respect of any dispute arising out of or in connection with these Terms or the Service.
